Food and Health Communications, Inc End User License Agreement and License to copy FHC Materials for Educational Purposes

THIS IS A LEGAL AGREEMENT between you and Food and Health Communications, Inc.; please read it carefully before downloading or using our products. By using our materials you agree to be bound by the terms of this agreement. If you do not agree, YOU MUST promptly return the unused files along with a destruction agreement for a full refund.

Grant of License
Food and Health Communications, Inc grants you the nonexclusive right to copy the files onto your computer hard drive and to use them and any derivatives or copies of the Food and Health Communications, Inc materials (collectively "the FHC materials")  with one company at one location. Additional site license are available for a discount by contacting us (click on contact below).

The FHC materials may be copied and incorporated in materials for educational use. They may be changed as needed to suit your audience. Please indicate, "© www.foodandhealth.com - reprinted with permission" on materials that use our copy.

The FHC materials may not be resold and may not be incorporated in products for sale without written permission. For example, you may use the FHC materials in handouts you create, newsletters you write, blogs you publish, PowerPoints you present, as part of your services such as classes or counseling or for other presentations you conduct for educational purposes but you may not use them in a book that will be sold or a PowerPoint show you resell or as part of any other materials or presentations that you sell without prior written permission.  Pornographic or illegal use of the FHC materials or images is prohibited.

This license is for the original purchaser of the FHC materials. You may not allow third parties to use it. You may use the materials on your company website or intranet. If you want to put it on more than one website you should get permission.

Additional rights are available. If you are unsure of your rights under this agreement or wish to use the images in a manner not permitted by this agreement, such as in products for sale, please contact Food and Health Communications, Inc for information and additional licensing options.

CFFH MEMBERS may make unlimited copies of free materials by following these guidelines. Non-members may make up to 25 copies of free materials unless written permission is obtained. Purchasers may make unlimited copies for one site by following guidelines stated here.

Warranties. Food and Health Communications, Inc. warrants that it has the right to grant this license to you. Food and Health Communications, Inc
warrants this disc to be free from defects in material and workmanship.  Your sole and exclusive remedy for breach of these warranties is the replacement of the disc. Food and Health Communications, Inc makes no other warranty, express or implied, including without limitation, any implied warranties of merchantability or fitness for a particular purpose. Some states do not permit the exclusion of implied warranties and you may have other rights, which vary from state to state. We are not reliable for data loss and or corruption that may result from the use of the CDROM.

GENERAL.
All rights to this disk and the FHC materials are owned by Food and Health Communications, Inc and are protected by United States copyright laws, International treaty provisions and other applicable laws. You may not use the Food and Health Communications, Inc. name except as a credit or copyright notice with the FHC materials. You may be held legally responsible for any copyright infringement that is caused or encouraged by your failure to abide by the terms of this agreement. Food and Health Communications, Inc. retains all rights not expressly granted by this agreement. This disc is licensed only to you. The license granted under this agreement may not be transferred without the prior written consent of Food and Health Communications, Inc. and will terminate automatically without notice from Food and Health Communications, Inc if you fail to comply with any provision of this agreement. Upon termination, you must stop using the disc and FHC materials and must return the disc and all copies of it to Food and Health Communications, Inc. immediately.

This acknowledges that by using our products you agree to be bound by these terms.
